Who We Are

Mighty Kids Supplements INC, a company incorporated in Texas (“Mighty Kids”, “we”, “us” or “our”), is the business responsible for your personal information and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and protect personal information of the United States when you visit https://mightykids.com, purchase our products, sign up for marketing, or otherwise interact with us. 

This policy is written to meet the requirements of the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively the “CCPA”), and applies that standard to all US residents. The rights available under the California model are substantively similar to those provided in other US states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas, New Hampshire and New Jersey among others). To exercise your rights, use the same email address under the section titled “Your Rights”.

This policy does not apply to personal information governed by our EU/UK privacy policy or to de-aggregated/de-identified data which no longer identifies you.  

What Personal Information Do We Collect

We collect, or may collect, the following categories of personal information from you: 

1. Identifiers: name, postal address, email, phone number, account username, IP address, online/device identifiers
2. Commercial information: products purchased or placed in the basket, order history, preferences
3. Internet activity: interactions with websites and advertisements, browsing on the site  
4. Geolocation data: approximate location derived from the IP address 
5. Customer records: name, payment card, financial account information 
6. Protected classification characteristics: age/date of birth and gender

We do not collect any biometric data, employment or education information, nor do we generate any inferences from the collected information. 

In respect of sensitive personal information, while we do collect customer records and account log-in details, this is for the performance of Mighty Kid’s services and processing of orders. It thus does not trigger a right to limit. We do not collect any other sensitive personal information, including Social Security or government identification numbers, precise geolocation, health information, or information revealing racial or ethnic origin, immigration status, religious beliefs or sexual orientation. 

While our products are made for children, Mighty Kids’ website is not directed to children under the age of 13 and does not knowingly collect personal information from children under the age of 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it. 

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources: 

1. Directly from you: for instance, through account creation, reviews, newsletter signs ups
2. Automatically from you: through cookies we or our service providers set 
3. Indirectly from you: through your browsing activity while on our website

How and Why We Use Personal Information

We retain each of the categories of Personal Information described above for the period necessary to provide goods and services to you and for the period reasonably necessary to carry out the purposes below. 

Your personal information may be used for the following purposes: 

1. Creating and managing your account, including sending you market communications subject to your preferences
2. Providing and maintaining our services, including processing and delivering your orders, managing payments 
3. Attending and managing your requests to us
4. Detecting, preventing and investigating fraud and security incidents
5. Complying with our legal and regulatory obligations 
6. Enforcing legal rights or defending legal claims 
7. Administering and protecting our website, including troubleshooting, data analysis and system maintenance
8. Analytics, product development and improving our site and services 
9. Managing your participation in prize draws or surveys

We may share your personal information in the following situations: 

1. With service providers such as payment service providers, warehouses, delivery companies, website hosts and marketing agencies which aid us in promotional work. We only allow those organisations to handle your personal data if we are satisfied they take appropriate measures to protect your personal data. We also impose contractual obligations on them to ensure they can only use your personal data to provide services to us and to you.
2. With external auditors in relation to the audit of our accounts
3. With Professional advisors, such as lawyers, who are under obligations of confidence
4. With law enforcement agencies, courts, tribunals and regulatory bodies for the completion of regulatory or legal obligations
5. For business transfers, such as in connection with any merger, sale of Company assets, financing or acquisition of all or a portion of our business to another company. Your personal information will be anonymised but this may not always be possible. 

In the preceding 12 months, Mighty Kids has not sold any personal information nor do we share it with organisations outside our group for cross-context behavioural advertising. We also do not disclose your personal information to third parties for those third parties’ own direct marketing purposes.  

Your Rights

You have the following rights in respect of your personal data, subject to exceptions: 

1. Right to know: the right to request disclosure of the categories/specific pieces of personal data that has been collected about you; the categories of sources of that information; the purposes for which the information has been collected, and who the data has been disclosed to. 

You can make a request to know up to twice a year, free of charge.

2. Right to delete: the right to request the deletion of personal information, subject to certain exceptions. 

3. Right to opt out: the right to request that your personal information not be shared or sold. Sharing refers to the sharing of personal data for cross-context behavioural advertising. Once your opt-out request is received, your personal information will not be shared unless you later authorise.

4. Right to correct: the right to have inaccurate personal information corrected. 

5. Right to limit: the right to have your sensitive personal information used for limited purposes only, such as providing you with the services or goods expected. 

6. Right to non-discrimination: right to not be discriminated against for exercising any of the above consumer rights. However, do note that if you refuse to provide personal information which is necessary for us to provide you with products, or ask for it to be deleted, we may not be able to perform the contract. In this case, we may have to deny the request or cancel your service.  

To exercise any of the above rights, you may submit a request via email to [email protected]. We will respond to verifiable requests within 45 days, extendable by a further 45 days where reasonably necessary, in which case we will inform you. We cannot respond to requests or provide you with the required information if we cannot verify your identity and confirm that the personal data relates to you, so do provide sufficient information for verification. If we decline your request and you reside in a state that provides an appeal right, you may appeal by contacting us at the email address above. We will respond within the period that state’s law requires. 

In respect of the right to opt-out, we do recognise “Global Privacy Control” signals as described in the section titled ‘Cookies’.

Cookies

Our website uses cookies, which are small text files stored on your device to remember your preferences and recognise your device. Beyond essential cookies which are required for the website’s functionality, our website primarily uses analytical cookies and advertisement cookies. 

Analytical cookies allow us to understand how visitors interact with the website. Information collected may include the number of visitors to the site and where visitors have come to the website from. The data collected does not contain any personally identifiable information. 

Advertising cookies allow us to analyse the effectiveness of ad campaigns and provide you with customised advertisements. These cookies are also used to limit the number of times you see an advertisement. Information collected may include the type of device, the pages visited and interactions with websites. 

If you do not wish to have cookies placed on your browser, you can set your browser to refuse all or some browser cookies. Do note that if you disable or refuse cookies, some parts of this website may become inaccessible or may lose some functionality.

Our website currently does not respond to “Do Not Track” browser headers. However, we do recognise “Global Privacy Control” signals (“GPC”). If you enable GPC on your browser, we will take it as a valid opt-out request automatically. 

Notice of Financial Incentives

Mighty Kids offers a loyalty programme which may constitute a “financial incentive” under the CCPA as, under the programme, you receive discounts connected to personal information you provide. Once you create an account, you earn 1 point for every €1 spent on our products. You can redeem your points for discounts (100 point = €10 off your next order). Points will expire three months after you earn them. 

To run the programme, we collect and retain the following personal information: name, email address, account login, order and transaction history (used to calculate, store and apply your points).

Please note that participating in the loyalty programme is entirely optional. You will have to affirmatively opt-in to the programme by creating an account, and you may terminate programme participation at any time as explained in the applicable program terms. If you leave, you will stop earning points. Leaving does not change the price you pay for our products outside the programme, and you will not be discriminated against for exercising your privacy rights. The only difference in price between members and non-members is the value of the points you earn and later redeem. We estimate the value of your personal data by reference to the value of the rewards we give you in exchange for it. The programme returns approximately 10% of your qualifying spend. We therefore estimate the value of your data to us, in connection with this programme, at approximately 10% of what you spend while enrolled.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. However, no system is completely secure and we cannot guarantee absolute security. 

Transfer of Your Personal Data

Mighty Kids is part of a group with operations in the EU and parent company in the United Kingdom (“UK”). Data from customers in the US will primarily be processed at our operating office and in any other places where the parties involved in the processing are located. This means that your personal information may be transferred to computers located outside of your state or province. Further, your data may be transferred to our parent company in the UK. Where we make such transfers, we will take steps to ensure your personal information receives a reasonable level of protection. 

Links to Other Websites

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.

Changes to This Policy

We may change this Privacy Policy from time to time. The date the Policy was last revised is included at the top of the page. When significant changes are made, we will take steps to inform you, for example by including a prominent link to a description of those changes on our website for a reasonable period or by other means, such as email.
